The "statutory employer" question
In Georgia, a general contractor can sometimes be treated as the employer of a subcontractor's workers for workers' comp purposes, which can protect the GC from a lawsuit. This depends on how the contracts are set up, so we review them.
Who else might be responsible
- Another subcontractor whose crew created the hazard
- The maker or seller of defective equipment
- A rental company that provided unsafe equipment
- The property owner or site manager
- An engineer or inspector, in some cases
Repaying workers' comp
If you recover in a third-party case, the comp insurer may have a right to be repaid from it, in certain conditions. We negotiate that too.
